It has been our law firm's experience that the best solution is to find an agreement out of court. When parties are unable to reach an agreement, then Family Services may become involved, resulting in an investigation. If a relocation hearing is held, the court typically relies on the opinion of Family Services and/or a Guardian ad Litem if one is appointed.

  • Relocating children and the primary custodial parent out of state — A new parenting plan could include summers with the non-custodial parent, and longer holidays. In some cases, the primary custodial parent would change to allow the children to remain in state. Child custody and child support modifications may need to be made.   • Non-custodial parent out of state relocation — How will the non-custodial parent keep a relationship alive with the children? Who will pay for transportation or airline flights? Modifications may need to be made to the parenting plan or child support agreements.
  • Relocating within the same state — There are several considerations to consider. Are school-aged children changing school districts? Is mid-week visitation no longer a practical option? How does this affect holidays and vacations?
  • Relocating to protect the children — In rare cases, a parent may have addiction or other issues and an out-of-state relocation is pursued to limit the children's contact with a parent. We can help you determine your options and reach a decision if this is your case.
